Nesmund Logistics Services, a State of Georgia Limited Liability Company operating out of the beautiful city of Cartersville, is a duly formed “bona fide agent” actively providing freight dispatching services for active authority fitness-only carriers (general freight, except household goods) across all lanes of operation in the United States. According to the FMCSA, Bona fide agents are persons who are part of the normal organization of a motor carrier and perform duties under the carrier's directions pursuant to a preexisting agreement which provides for a continuing relationship, precluding the exercise of discretion on the part of the agent in allocating traffic between the carrier and others.

In order to utilize the services of a freight dispatching service provider and preclude the exercise of discretion (a dispatching service provider choosing which carrier to give a load to), carriers (owner operators, fleet owners) that wish to onboard dispatching services, need to have a signed dispatching agreement in place, and indicate their operating preferences. Operating preferences include travel lanes of operations, types of loads, equipment types operated, etc. With such an agreement, a carrier authorizes the freight dispatching services provider to represent the carrier in load searches, bookings and dispatching on behalf of the carrier, along the lines of the agreement and operating preferences, both from new and existing brokers that the carrier had been approved with. 

In the absence of a signed dispatching agreement and indicated operating preferences, loads dispatched for carriers are not subject to the exercise of discretion preclusion, as such loads will be dispatched on a case-by-case basis for carriers based on availability, having the required equipment, the proper credentials, rate acceptance, etc. The choice is yours as a carrier.
